My brother's money is stuck with employer!

This query is about my younger brother, who is into show business.
He is doing well in the sense that he is doing what he loves, but his health keeps on giving him trouble! Earlier it was legal problems and now it is health and money due by his employer! it is a money owed for many a months now, but the employer refuses to pay, especially because he did not ask for a written contract with details.
He plans to quit next month and move on. Would he get his due from this employer?
